Inspection of playgrounds and outdoor fitness areas

No regulation obliges an operator to use an accredited inspection body, and none sets a numerical inspection frequency: in France no approval scheme was ever created for inspection and maintenance providers. What the standard does require, for the annual main inspection, is an independent and competent person, which in practice rules out whoever carries out the maintenance, including the council’s own technician.

This page explains who may inspect, how often, what it costs and what to do after an adverse report. The inspection levels come from EN 1176-7 and apply wherever those European standards are used; the enforcement references are French and serve as a worked example of how a national authority interprets them.

Who may carry out inspections

This is the most misunderstood part of the subject, and the answer comes in two stages.

Two practical consequences are rarely appreciated. In a small municipality where the same person maintains and inspects, the independence requirement is not met for the annual inspection, and that is the substantive argument for bringing in a third party. Equally, a manufacturer that maintains equipment cannot carry out its main inspection, for the same reason.

French guidance confirms that no approval scheme was provided for by the regulations, and a ministerial answer on the qualification of municipal staff states that no required qualification level is set, the ministry merely recommending appropriate diplomas or specialised training. Accreditation schemes exist and several inspection bodies hold them, but they remain voluntary. Nothing prevents a buyer from requiring a qualification in its own contract: what may be required in a contract and what the law imposes are two different things. The three inspection levels and their frequency

The French decree fixes no numerical frequency. It imposes an obligation of result, equipment maintained so as not to present a risk, and a documentary obligation: draw up an upkeep plan and a maintenance plan stating the nature and frequency of inspections, then comply with them and record them in a register.

Frequency therefore depends on the manufacturer instructions, the level of use and the climate. Departing from the usual rhythm is not unlawful; it simply obliges you to justify your own reference framework in litigation where the authority already carries the burden of proof. Three distinct regimes

Confusing these three regimes is the most common error in this field. A great deal of published guidance applies the play area decree to adult fitness areas, which is wrong: that decree covers equipment intended for children under 14. The duty on an adult fitness area is no lighter, it simply comes from elsewhere.

What an inspection costs

Published price lists are rare. The figures below are the only genuinely documented orders of magnitude.

A defensible order of magnitude is 150 to 300 euros excluding VAT per area for an annual inspection of a simple site, and from a few thousand to a few tens of thousands of euros a year for a municipality’s whole stock depending on its size. Those amounts bear no comparison with the cost of litigation, still less with a judgment against you for want of evidence that the equipment was maintained.

After an adverse inspection

  1. Prevent access to any item that no longer meets safety requirements, until corrective measures have been taken.
  2. Signal that the item is out of use. Removing broken parts without appropriate signage has already been held insufficient to rebut a failure to maintain.
  3. Correct the defect, then record the correction in the register: the obligation is to log not only the finding but the follow up.

No regulatory deadline exists for bringing equipment back into compliance. A court assesses whether the repair time reflected reasonable diligence, which in practice means days for a hazard and weeks for a cosmetic defect, each recorded.

Frequently asked questions

Must an accredited body inspect a play area?

No. No approval scheme was created for inspection and maintenance providers. Accreditation exists and several inspection bodies hold it, but it is voluntary. What the standard requires for the annual inspection is an independent and competent person, which is a different test from accreditation.

Can a council employee carry out the annual inspection?

Can a manufacturer inspect equipment it maintains?

Not for the annual main inspection. The standard requires an independent person who took part in neither the installation nor the maintenance and who does not decide the budget for remedial work. The manufacturer can perfectly well carry out operational inspections and repairs.

What should be done with a report flagging a non conformity?

Prevent access to the item concerned and signal it, correct the defect, then record the correction in the register. An adverse report filed and forgotten is worse than no inspection at all, because it establishes that the authority knew about the hazard.
